Q and A with the Ronival team
While Nick Fong meets at the table with Sergio Benitez, Ronival’s Operations Manager, the two of them answer question submitted frmo the Ronival team. They are joined by the team online. The questions are asked each week and listed out to be read and answered in this PODCAST. Since Nick Fong brings all of his great experience and knowledge to the table, the answers are well informed.
Regarding how the days stated on contracts: Question#1
The first question is asked by Emma, a Ronival Real Estate agent from Los Barriles. In the video, she asks:
“Can you help us define business days and calendar days on contracts? For example, is Saturday considered a business day and how do we deal with national holidays?”
To answer this question, Nick says that this is a problem that comes up with different holidays from the United States, Canada, and in Mexico. To elaborate, the days must be stated and the country where the buyer is from must be documented. As such, this will ensure it won’t be contested legally down the road. Nick’s recommendation is even simpler. He says to spell out the actual calendar days as “January 11, 2022” versus numbers like “01/11/2022.”
There is a great reason to spell the date instead of using numbers. In Canada and the United States, the numbers are listed as MONTH/DAY/YEAR. In Mexico, the day and month are in reverse. To explain, the date in Mexico is stated as DAY/MONTH/YEAR. As an example, Nick says that a client lost a 150,000 deposit 15 years ago, simply because the day and month were in reverse.
Make sure your name is listed in the MLS: Question#2
Asking the second question as well, Emma of Los Barriles asks:
“What is the best way to document yourself as the selling agent in the MLS?”
According to Nick, if the selling agent is not shown as the selling agent in the MLS, bring this up to the listing agent and ask them to make the change. If the listing agent says something like “I’ll think about it,” and will not commit, then bring it up to your broker. An inquiry from your broker should resolve this issue. If it doesn’t, a complaint will be submitted to the MLS from your broker.
Also according to Nick it’s important to understand the difference between the listing agent and the selling agent. The selling agent represents the buyer. That agent is “selling” the property to that buyer. The listing agent represents the property owner when it is being sold. Just think of yourself as the one selling the listing agent’s listing to your buyer to avoid confusion.
